Call to Order
Mr. Bryant called the meeting to order at 11:05 a.m.
Mr. Bushnell previously advised Council staff of an error in the draft minutes and Mr. Harris made the correction noted. Mr. Sengel moved to adopt the minutes with Mr. Bushnell’s correction. Ms. Addison seconded the motion and it passed unanimously.
Mr. Bryant deferred the Chairman’s report.
Mr. Harris stated that the next statewide program scheduled is the Executive Program at the Richmond Omni on December 6 – 8, 2007. Mr. Harris gave a listing of all the training topics and stated that this year’s program generally follows a theme of the prosecutor in the community. Mr. Iden asked who will present the topic “Translating the Conflict of Interest Act into English: Writing Opinions.” Mr. Harris replied that Mr. Doucette will present that topic.
Mr. Harris presented a list of special invitees and a copy of the special invitee letter. Mr. Harris stated that all invitees are welcome to attend the entire program. Mr. Horan was included on the special invitee list. Mr. Bryant asked if there were any objections to inviting Mr. Morrogh to attend the program as the Commonwealth’s Attorney for Fairfax County. There were no objections. Mr. Bryant asked everyone to notify CASC of any additions to the special invitee list.
Loan Forgiveness / Federal Legislation Update
Mr. Harris updated Council on the status of federal legislation providing loan forgiveness opportunities for prosecutors. A Senate bill (S.442) the “John R. Justice Prosecutors and Defenders Incentive Act of 2007” was included as an amendment to the “Higher Education Amendments Acts” (S.1642) which passed the Senate. The House version (H.R.916) has passed the House. The two versions of the “John R. Justice” bill would provide federal student loan repayment assistance of up to $10,000/yr for an aggregate total of $60,000, with a minimum 3-year commitment (with 3-year renewal).
A separate bill “The College Cost Reduction and Access Act” (H.R.2669) has passed both the House and Senate and was signed by the President on September 27, 2007. It offers some assistance to individuals with federal loans by reducing interest rates, limiting repayment amounts and canceling federal direct loan payment for public service employees after 10 years of payments (after October 2007) but it does not contain the “John R. Justice Act” provisions. The NDAA is still working to pass that legislation.
DCJS Criminal Justice Plan
Mr. Bryant stated that he is very pleased with the number of Commonwealth’s Attorneys who attended the regional meetings. One more meeting is planned for the week of October 22 – 26, 2007. Mr. Herring agreed to attend this meeting. Mr. Harris will give the required contact information to Mr. Herring
CASC Budget Issues
Mr. Harris stated that the Governor requested state agencies to look for strategies to reduce the budget by 5%. Mr. Harris stated that CASC would forego general funds for the Trial Advocacy program, and substitute grant funding for the program. Mr. Harris alerted Council to the potential for future budget cuts. Mr. Harris also advised Council that new travel regulations have precluded state employee travel outside the Commonwealth.
Mr. Harris stated that CASC is sponsoring two regional “Training A La Carte” programs. The Cybercrime and Telecommunications Investigation and Prosecution program is scheduled for October 10-11, 2007 and will be held at the Arlington County Courthouse. A DWI-D enforcement and prosecution program is scheduled for November 30, 2007 at the Wytheville Community Center. Mr. Harris will make available the Conflict of Interest training at the next Board and Council meeting held on Wednesday, November 7, 2007. Mr. Harris also stated that DVDs are available for anyone who is unable to attend the training.
Council Vacancy – 11th District
Council noted the retirement of Mr. Horan and the vacancy in the 11th District representative position. Mr. Bryant moved to add Mr. Raymond Morrogh in place of Mr. Horan as the 11th District representative and Council approved the motion unanimously.
The meeting adjourned at 12:06 p.m. The next regularly scheduled Council meeting is 11:00 a.m., Wednesday, November 7, 2007, at the Henrico County Sheriff’s Conference Room.
