DESCRIPTION:Instructor: Amos N. Guiora\, \nAmos N. Guiora is Professor of Law at the S.J. Quinney College of Law at the University of Utah. He is actively involved in bystander legislation efforts in Utah and other states around the country. \nProfessor Guiora has an A.B. in history from Kenyon College\, a J.D. from Case Western Reserve University School of Law\, and a Ph.D from Leiden University. He has published extensively both in the United States and Europe on issues related to national security\, limits of interrogation\, religion and terrorism\, the limits of power\, multiculturalism\, and human rights. \nHis books include Armies of Enablers: Survivor Stories of Complicity and Betrayal in Sexual Assaults (2020); Five Words That Changed America: Miranda v. Arizona and the Right to Remain Silent (2020); Populist and Islamist Challenges for International Law (2019); The Crime of Complicity: The Bystander in the Holocaust (2017); Earl Warren\, Ernesto Miranda and Terrorism (2018); Tolerating Intolerance: The Price of Protecting Extremism (2014); and Freedom from Religion: Rights and National Security (2009). \nProfessor Guiora is a Distinguished Fellow at The Consortium for the Research and Study of Holocaust and the Law (CRSHL)\, Chicago-Kent College of Law\, and a Distinguished Fellow and Counselor at the International Center for Conflict Resolution\, Katz School of Business\, University of Pittsburgh. \nSession Description:  \nProfessor Guiora’s presentation is based on his interviews with survivors of sexual assault from USA Gymnastics\, Michigan State University\, Ohio State University\, and the Catholic Church\, plus thousands of pages of Grand Jury indictments\, civil lawsuits\, criminal prosecutions\, special reports\, and media accounts. As in his book Armies of Enablers: Survivor Stories of Complicity and Betrayal in Sexual Assaults\, he focuses not on what the sexual predators did to them\, but on how the institutions and individuals allowed it to happen. \nHe will discuss the criminalization of bystanders and enablers\, which reflects recognition that failure to aggressively prosecute those who acted by not acting ensures perpetrators will continue to act with impunity and immunity. That is the direct consequence of failing to act on behalf of survivors. In advocating criminalization of bystanders-enablers\, the underlying premise is that they owe a duty to the person in peril. Efforts to protect require penalizing all those who directly and indirectly contributed to that harm. DESCRIPTION:Presenter: Marlesse Jones \nMarlesse Jones is the Utah Prosecution Council Sexual Assault/Domestic Violence Resource Prosecutor for Utah.  Her career includes 911 dispatcher\, paralegal\, and victim advocate.  She obtained a bachelor’s degree in Social Work from Weber State University (2002).  Marlesse established and ran the Layton Victim Services program\, responding to domestic violence\, sexual assault\, suicide\, and homicide scenes to provide crisis intervention and liaison support to survivors throughout the investigative and prosecution process. Marlesse graduated from the University of Utah\, S.J. Quinney College of Law with a juris doctorate degree in 2011.  She prosecuted in the District Court\, Layton Department for seven years.  In January 2018 Marlesse joined Utah Prosecution Council. \nMarlesse served as a former Chair of the Second District Victim Rights Committee and the Davis County Coalition.  Currently she is Vice-Chair of the Utah Crime Victims Council\, and a member of the Sexual Violence Advisory Council\, the Domestic Violence Advisory Council\, and the Crime Victims Conference Committee. Marlesse has been training throughout Utah for many years on victim issues and due to her past experiences brings a unique perspective to working with the various professionals in the criminal justice system. \n Session Description: \nThis presentation seeks to create a greater self-awareness of our bias(es) in domestic violence and sex crime cases.  We all bring to prosecution expertise\, education\, and life experience.  But what if some of what we know is more historical than accurate\, more comfort zone than truth\, more limited than complete? How does this affect our assessment and prosecution of cases? How do we do better in seeking the justice that we work so hard to secure?  This presentation will explore bias\, how it impacts our thinking\, and how to challenge those thinking habits to flush out unconscious biases. SUMMARY:Advanced DUI Staunton
DESCRIPTION:Topics to be covered at this intensive training include Investigative Stops\, Checkpoints\, Blood Testing Issues and DUI Manslaughter.  The latest version of the Virginia DUI Manual will be distributed to participants. Much like our TOP GUN Program\, this training program utilizes a team-training format requiring a team consisting of a prosecutor and a law enforcement officer from the same jurisdiction. \nThis training will be limited to 36 resident attendees and 10 commuting attendees. Lodging and meals will be covered for those who reside more than twenty-five (25) miles from the training site. Lunches are covered for commuting attendees. No mileage reimbursement will be provided. \nPreference is given to teams consisting of an officer and a prosecutor from the same jurisdiction. Registration does not guarantee acceptance to the program – confirmation of selection for program will be sent out in July. \nRegistration for this program has closed.

Liability can depend on both federal and state law\, and can turn on what activity is at stake: from consulting on investigations\, such as advising on search warrants\, investigative techniques\, suspect interviews\, when to get an arrest warrant\, etc.\, to allegations of discovery/Brady violations and “wrongful” convictions\, to allegations of wrongful accusations of false testimony\, as well as potential liability for placing officers on “Brady lists”\, etc. This webinar will discuss these challenging issues\, as well as concerns from failures to prosecute\, malicious prosecution\, and liability from public statements. SUMMARY:Investigation and Prosecution of Gang Cases ("Gang Busters VIII")
DESCRIPTION:Gang Busters will NOT be offered September 12-17\, 2021. It has been cancelled due to low enrollment. Gang Busters will be offered in 2022\, registration will open in Spring 2022.\n \nGang Busters is an intensive\, workshop-style\, interactive training course on the prosecution of gang cases\, similar to TOP GUN one of CASC’s longest running programs. Attendance is limited to 20 teams\, each of which consists of a prosecutor and a law enforcement investigator from a given jurisdiction. This program covers the latest developments in the law\, the criminal practices used\, an exercise in qualifying as a gang expert and the latest developments in gang investigation and prosecution. The training will be held in Williamsburg. This is a five day program. There is no tuition: housing\, private rooms\, for attendees whose offices are more than twenty-five miles from the training site and all meals are provided or reimbursed. Mileage to and from the training is not covered. \nThis program is open to Virginia prosecutors and law enforcement. \nACCEPTANCE IS BY APPLICATION ONLY. SUMMARY:FURY ROAD: Investigating and Prosecuting Impaired Fatal Crashes
DESCRIPTION:This intensive two-day training will cover crash scene evidence collection\, crash reconstruction\, the DRE investigation\, charging decisions\, victim outreach\, and more! FURY ROAD begins at 8:30 a.m. on Monday\, September 20 and ends at 5:00 PM on Tuesday\, September 21. The training will now take place in Richmond (not Staunton). This program is limited to approximately ten (10) resident teams and five (5) commuter teams of two (2) people. Commuters are those who reside within twenty-five (25) miles of the training facility. Teams must include a prosecutor and a law enforcement officer who is either a Virginia State Trooper\, a member of a local jurisdiction’s crash response team\, or regularly involved in investigating fatal motor vehicle crashes. \nRegistration does not guarantee acceptance. Registrants will be notified by July 9th whether they have been accepted into the program.   Details on the training facility and program will be provided in the acceptance letter. CASC will not provide travel mileage reimbursement for this program and students will be responsible for their own meals. CASC will provide lodging for resident teams. \nThis program is for Virginia prosecutors and law enforcement officers only. \n
